Income Tax Penalties Law & Practice By G.C.Das I.R.S (Retd) Edition 2026

Description

The law on penalties under direct taxes has always been an area of both practical and conceptual significance. Over the years, the provisions have undergone repeated amendments. This book, “Income Tax Penalties-Law and Practice”, seeks to present a comprehensive study of the penalty provisions, giving a comparative presentation under various sections of the Income- tax Act 2025 and corresponding provisions of Income-tax Act 1961so that changes could easily be identifiedand analysed under both the Acts.

A close examination of the newly introduced penalty provisions in 2025 Act shows that most of the changes in penalty provisions are largely structural, intended to simplify the language and reorganize the sections rather than to introduce substantive alterations to the underlying settled legal principles. The fundamental principles governing the initiation, and imposition of penalties remain largely the same although ithas always been in the minds of law makersto simplify penalty regime and not to depend too much on a’deterrence model’ as an instrument of voluntary tax compliance. Be that as it may, much however depends upon the manner in which the new provisions are administered and interpreted in practice.

One noteworthy development in the penalty regime is the introduction of the Block Assessment Scheme with effect from 1st September, 2024, which provides immunity from certain major assessment-related and other penalties. This represents a constructive step towards encouraging voluntary disclosure and reducing prolonged and unproductive litigation. Despite the availability of such statutory immunity, experience suggests that many taxpayers subjected to search proceedings continue to adopt a highly defensive posture, often preferring litigation on technical or even settled issues. At the same time ,it is also observed that established and time-tested judicial principles are not always given due consideration at the administrative level, resulting in multiplicity of proceedings, high-pitched demands, and avoidable hardship.

The book includes a valuable chapter on the “Principles Governing the Interpretation of Penal Provisions” as evolved through judicial pronouncements over the years.
