The Right to Information Act is one of the biggest achievements of Indian democracy. It is a powerful anti-corruption tool. The Act, with one of the most powerful legislations of its kind in the world, is also the closest to the citizen’s heart. Its success lies in its simplicity. It has empowered the citizenry in an unprecedented manner to participate in nation building by promoting transparency and accountability in the working of every public authority.

RTI laws, as they are commonly called, grant citizens legal rights to access information held by their governments, bringing much needed transparency and preventing opaque functioning of government. A number of Public Authorities, though not much, as was envisaged in the Act under section 4, have adopted certain practices that have resulted in better transparency and accountability in their functioning, thereby leading to more effective implementation of the RTI Act. A law demanding transparency in public service, which is steeped in so much dishonesty, is bound to get mired in problems of interpretation, some real, some contrived. Aside from varying interpretations of the RTI law, there is also wide divergence in the procedures and conduct of Public Information Officers (PIOs) and Information Commissioners. There are more worrying trends in the enforcement of the Act, such as Information Commissioners reluctance to impose penalties on PIOs who dont answer an RTI application in 30 days and provide information to the information seekers.

The present volume, now in its sixth edition, contains an exhaustive commentary in simple but interesting language on all the sections of the Act with appropriate comments. The author has made all efforts to consolidate all laws relating to right to information and present in a lucid language, in a coherent manner and logical sequence. Besides the sectionwise commentary, it deals with certain important issues, such as, Privacy and RTI, RTI and Public Interest, Analysis of Data Protection Act and RTI vis-à-vis Indian Evidence Act. It also contains specimen that can be used for not only moving first application under the Act to seek information but also specimen application forms for moving first and second appeal too. Another uniqueness of this book is that a separate Division has been exclusively devoted on framing the questions for moving an application under section 6 of the Act.

Dr Niraj Kumar :DR. NIRAJ KUMAR (b. 1952) is Former Director & Head, Department of Business Administration, Lucknow University, Lucknow. He is Advisor/ Consultant/Director to Columbia Holistic University, California, USA; Management Studies Promotion Institute, New Delhi; N.N.W. News Agency, Delhi; Asian Regional Institute for JUCHE Study, H.Q. Tokyo; Wizards Business Machines (P) Ltd., U.S.A.; National Integration Management Institute, Lucknow; National Career Institute, New Delhi; Amigo Trading & Supplies Co. Ltd., Hong Kong; Best House, Bangkok, Thailand; Director, Rotary Club (Lucknow West).

He holds a doctorate in Business Administration besides holding a Law Degree. He has been conferred with the Paul Harris Fellow – 1996 of Rotary International, USA. Dr Niraj Kumar has also been conferred with Super Brain Award – 1988 by the Columbia Holistic University, USA; Excellent Services Award – 1977 by Senior Citizens Medicare & Rehabilitation Federation, New Delhi; Super Intellectual Award – 1977 by All India Management Council, New Delhi; Best Citizen of India – 1998 by Global Publishers, International Publishing House; Outstanding Personalities of India –1998 by Management Studies Promotion Institute, New Delhi; Gem of India – 1998 by All India Management Council, New Delhi; Rotary Foundation District Service Award – 1997 of Rotary International, USA; L. Sarweshwar Dayal Saxena Appreciation Award – 1984 by Akhil Bhartiya Ageet Parishad, Lucknow; L.U.A.T.W. Employees Union Gold Medal – 1974; Business Administration Association Merit Plaque – 1973 and many more.

Having brilliant academic records with Merit Scholarships and Gold Medals, he has been honoured with the Vice Chancellors Testimonial of being one of the finest students on the Rolls of Lucknow University. He was an U.G.C. Research Fellow and was also on the teaching faculty of Banaras Hindu University in the areas of Commerce and Management Studies.

Besides varied experience in journalism, he is a regular contributor to research and professional journals on Management, with specialization in Behavioural Science, Personnel Communications and Business Laws.

Several Books are to his credit, out of which Communication in Indian Industries; A Genesis of Behavioural Science; Dictionary of Management & Business Administration; Marketing Communications: Theory & Practice, Peoples Paradise in the East have the credit of being the first book on the subject by an Indian author. Dr. Niraj Kumar has to his credit 33 Books, 92 Research Papers/Academic Lectures, more than 250 General Articles besides a large number of Radio Talks.

He retired as Director, Department of Business Administration, University of Lucknow. Presently, he is working as a Management Consultant and Grade Certified Trainer for RTI Act by Government of India.
